Today, the Udall amendment failed in the U.S. Senate, allowing continued authority of the military to indefinitely detain without charges individuals – including American citizens apprehended on U.S. soil. It also forces law enforcement officials to transfer a large category of terrorism suspects into military custody. Its failure allows the restrictions on the transfer of cleared Guantanamo detainees to continue as well.

This amendment failed, despite its criticism from retired military leaders, the director of the the FBI, national security experts, and may undergo a presidential veto.
